Thank you for choosing Easy Cater. These Terms of Service ("Terms") are intended to make you fully aware of your legal rights and responsibilities with respect to your access to, and use of, the Easy Cater website at https://easycater.co.in (the "Site") and any related mobile or software applications - including the Easy Cater User Application (Android and iOS) - collectively referred to as the "Easy Cater Platform" or the "Services".
These Terms are effective for all existing and future Easy Cater users, including but not limited to customers placing food orders, merchants listing their businesses, and delivery pilots fulfilling deliveries.
Please read these Terms carefully before accessing or using the Easy Cater Platform. By accessing or using the Platform, you are agreeing to be legally bound by these Terms and entering into a binding contract with EasyCater Services Platform Private Limited (hereinafter referred to as "Easy Cater", "we", "us", or "our"). If you do not accept these Terms, you may not use the Services.
You may accept these Terms by:
"Customer", "User", "You", or "Your" refers to you, as a user of the Services - being any person who accesses or uses Easy Cater for the purpose of ordering food, booking catering, reserving tables, booking event venues, or any other service offered on the Platform.
"Content" includes (but is not limited to) reviews, images, photos, audio, video, location data, and all other forms of information or data. "Your Content" means content you upload, share, or transmit through the Services - such as ratings, reviews, images, and profile information. "Easy Cater Content" means content Easy Cater creates and makes available in connection with the Services. "Third Party Content" means content that comes from parties other than Easy Cater or its users, such as Restaurant Partners and Merchants.
"Merchant Partner" or "Restaurant Partner" means restaurants, cloud kitchens, catering services, street food vendors, and event venues listed on the Easy Cater Platform.
"delivery pilot" means an independent gig-economy professional contracted through the Easy Cater delivery pilot Application for fulfilling delivery assignments.
Easy Cater reserves the right to modify, amend, or update these Terms at any time at its sole discretion. You are responsible for reviewing these Terms periodically. Your continued use of the Easy Cater Platform after any such change shall be deemed as your express acceptance of the updated Terms.
Easy Cater may, from time to time, provide translations of these Terms into regional languages for your convenience. However, the English version of these Terms shall always govern the relationship between you and Easy Cater. In case of any inconsistency between the English version and any translated version, the English version shall prevail.
a. You must create an account to use many of the features offered by the Easy Cater Platform. Your account is personal to you, and you are solely responsible for maintaining the confidentiality and security of your account credentials.
b. You may register using your mobile number (mandatory) and optionally link your email address. OTP-based verification is required.
c. You represent that all information provided during registration is true, accurate, and current. You must not impersonate any other person or create multiple accounts to circumvent platform policies.
d. You are responsible for all activities that occur under your account. You agree to immediately notify Easy Cater at support@easycater.co.in of any unauthorized use of your account.
e. By creating an account, you agree to receive communications from Easy Cater related to the Services, including order confirmations, promotional offers, and platform updates. You may manage your communication preferences in account settings.
a. You agree to use the Easy Cater Platform only for lawful purposes that are permitted by these Terms and applicable law.
b. You agree to use all data and content available on the Easy Cater Platform for personal, non-commercial purposes only, unless you have a specific written agreement with Easy Cater for commercial use.
c. You agree not to access the Services through automated means - such as scripts, bots, or web crawlers - unless specifically authorized by Easy Cater in writing.
d. You agree not to engage in any activity that interferes with or disrupts the Services or the servers or networks connected to the Services.
e. While communicating on the Easy Cater Platform - including giving instructions to merchants, communicating with support agents, or interacting with delivery pilots - you agree not to use abusive, threatening, defamatory, or obscene language. Easy Cater reserves the right to suspend your access for any such violations.
a. Easy Cater is the sole and exclusive copyright owner of the Services and Easy Cater Content. All intellectual property rights including trademarks, service marks, logos, trade names, and other proprietary rights associated with the Easy Cater Platform vest exclusively with Easy Cater.
b. You agree to protect Easy Cater's proprietary rights and comply with all reasonable requests to safeguard such rights. You acknowledge that Easy Cater - or its licensors - own all legal rights, title, and interest in the Services.
c. You agree not to use any framing techniques to enclose Easy Cater's trademarks or logos, and not to remove, conceal, or alter any copyright or proprietary notice. Any infringement may lead to legal proceedings against you.
a. Easy Cater grants you a personal, limited, non-exclusive, and non-transferable license to access and use the Services only as expressly permitted under these Terms. You may not use, copy, reproduce, modify, broadcast, distribute, or exploit Easy Cater Content except as expressly authorized by Easy Cater.
b. Any violation of the license provisions may result in immediate termination of your right to use the Services.
By submitting Your Content on the Easy Cater Platform, you irrevocably grant Easy Cater a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, assignable, sub-licensable, and transferable license to use, copy, display, distribute, modify, translate, and commercialize Your Content for any purpose, including in any media now existing or developed in the future.
a. You are solely responsible for Your Content. You represent and warrant that you own or have the necessary rights to submit Your Content, and that Your Content does not infringe the rights of any third party or violate any applicable law.
b. If Your Content is a review, you represent that it reflects a genuine experience, that you were not paid or otherwise incentivized to post it, and that it is an honest expression of your opinion.
c. You assume all risks associated with Your Content. Easy Cater is not responsible for the accuracy, integrity, or quality of content posted by users.
Easy Cater reserves the right to remove, block, or disable access to any Content that it considers objectionable, in violation of these Terms, or harmful to the Services or users, at any time and without prior notice.
a. Some content available through the Services may include or link to materials belonging to third parties. Your use of such third-party services will be governed by the terms of service and privacy policy of the respective third party.
b. Easy Cater has no control over and makes no representations regarding the accuracy, legality, or quality of third-party content. Easy Cater is not responsible for the availability of external sites or resources, and does not endorse any third-party content.
Customer reviews and ratings on the Easy Cater Platform reflect the personal opinion of the individual reviewer only, and do not represent the views of Easy Cater. Easy Cater is a neutral platform providing a communication channel between users and merchants. If a review is believed to violate Easy Cater's policies, the concerned merchant may write to support@easycater.co.in and Easy Cater may, in its sole discretion, remove such review.
You represent that you have read, understood, and agreed to Easy Cater's Content Guidelines and Policies as made available on the Platform from time to time.
You represent that you have read, understood, and agreed to Easy Cater's Privacy Policy. Easy Cater may disclose your information to third parties or government authorities where reasonably necessary to - (i) take action regarding suspected illegal activities; (ii) enforce these Terms or the Privacy Policy; (iii) comply with legal processes such as court orders, subpoenas, or other government inquiries; or (iv) protect the rights, reputation, and property of Easy Cater, its users, affiliates, or the general public.
Without limiting the generality of these Terms, in using the Services, you specifically agree not to post, transmit, or engage in any activity that, in Easy Cater's sole discretion:
Easy Cater has the right - but no obligation - to monitor access to or use of the Services for violations of these Terms.
a. Easy Cater facilitates food ordering and delivery by entering into contractual arrangements with Merchant Partners - including restaurants, cloud kitchens, street food vendors, and catering service providers - on a principal-to-principal basis for the purpose of listing their menu items on the Easy Cater Platform.
b. You can access menu items listed on the Easy Cater Platform and place orders against Merchant Partners through Easy Cater. Your request to place an order constitutes an unconditional and irrevocable authorization in favour of Easy Cater to place that order on your behalf.
c. Delivery of an order may be undertaken by Easy Cater's Delivery Pilots (independent contractors). Easy Cater acts merely as an intermediary connecting you with the Merchant Partner and the Delivery Pilot. Easy Cater shall not be liable for any acts or omissions of the delivery pilot, including deficiency in service, wrong delivery, order tampering, or delays.
d. A standard delivery fee of Rs. 11 per order is applicable (may vary by distance). You agree that Easy Cater is authorized to collect Delivery Charges on behalf of the Merchant Partner or delivery pilot as applicable. Easy Cater will inform you of applicable Delivery Charges at the time of placing your order.
e. Easy Cater is not a manufacturer, seller, or distributor of food and beverages. The Merchant Partner is solely responsible for the quality, safety, and accuracy of food and beverages sold, and for compliance with the Food Safety and Standards Act, 2006.
f. All prices listed on the Easy Cater Platform are provided by the respective Merchant Partner. Easy Cater does not guarantee the accuracy of such prices and shall not be liable for any discrepancy.
g. You are expected to treat delivery pilots with dignity and respect, and not discriminate on the basis of race, religion, gender, disability, sexual orientation, or any other legally protected characteristic.
h. You agree not to resell food or beverages purchased through the Easy Cater Platform.
A. Cancellation and Refund Policy - Food Orders

Refunds are processed within 5-7 business days to the original payment method.
i. You shall not be entitled to a refund where instructions placed with the order are not followed exactly as you intended, as instructions are fulfilled by Merchant Partners on a best-efforts basis.
j. Any complaint regarding food spillage, foreign objects, wrong delivery, or poor quality must be supported with photographic or other proof before a resolution can be provided.
B. Liquidated Damages
Your cancellation of an order - or a cancellation due to reasons attributable to you (such as providing incorrect delivery details, being unresponsive, or being unavailable) - shall constitute a breach of your irrevocable authorization to Easy Cater ("Authorization Breach"). In such cases, you shall be liable to pay liquidated damages equivalent to the value of the order components attributable to the Merchant Partner and delivery pilot. Easy Cater may deduct such amount from any future payment made by you on the Platform.
Where Easy Cater cancels an order due to technical errors, item unavailability, or reasons attributable to Easy Cater or the Merchant Partner, no liquidated damages shall be charged and any applicable refund shall be processed to you.
Easy Cater offers a digital payment feature enabling you to settle your dining bill at partner restaurants through the Easy Cater Platform. The following terms apply:
a. The 'Bill Amount' means the total amount set out in the dining bill for food and beverages consumed at a partner restaurant, including applicable taxes and service charges but excluding tips.
b. Upon paying the Bill Amount via Easy Cater, you will be required to show payment confirmation to the restaurant.
c. Easy Cater Pay Benefits - including instant discounts, cashback in the form of Easy Cater Credits, and other offers - are subject to the terms of each specific offer as communicated on the Platform.
d. Easy Cater reserves the right to modify, suspend, or discontinue Easy Cater Pay or any associated benefits at any time, with or without prior notice.
e. For any queries regarding Easy Cater Pay, please write to us at support@easycater.co.in.
a. You may request table bookings at partner restaurants through the Easy Cater Platform. Bookings are confirmed only after the restaurant accepts and confirms them, and confirmation is sent via SMS, email, or in-app notification.
b. A booking fee of Rs. 50 per person ("Booking Fee") may be charged at the time of reservation. This Booking Fee is adjustable against your final restaurant bill for food and beverages consumed.
c. Modifications to confirmed bookings are subject to acceptance by the restaurant. Easy Cater will use its best efforts to keep you informed of the status.

d. Easy Cater advises you to arrive at least 10 minutes before your scheduled booking time. The restaurant reserves the right to cancel a booking and allocate the table to other guests in the event of late arrivals.
e. In the event the restaurant fails to honour a confirmed booking, please raise a dispute with Easy Cater at support@easycater.co.in within 30 minutes of the scheduled booking time. Easy Cater will, in its sole discretion, investigate and may initiate a refund of the Booking Fee.
f. Easy Cater is not liable for any in-person interactions at the restaurant, or for the customer's experience, food quality, or service at the restaurant. Easy Cater is a platform connecting customers to restaurants and shall not be responsible for any acts or omissions of the restaurant.
a. Easy Cater offers a loyalty programme under which you earn 1 (one) Loyalty Point for every Rs. 1 spent across all Easy Cater services - including food delivery, dine-in, catering, event venues, and helper bookings.
b. Points accumulate automatically in your account after each transaction.
c. Loyalty Points can be redeemed at the rate of 1 Point = 1 Paise (i.e., Rs. 0.01), subject to a minimum cumulative spend threshold of Rs. 2,500. After crossing this threshold, you may redeem 1% of accumulated points per transaction.
d. Example: 2,500 Loyalty Points = Rs. 25 in redemption value.
e. Loyalty Points are applicable across all Easy Cater modules - restaurants, street food, dine-in, events, helpers, and all future services.
f. Easy Cater reserves the right to modify, suspend, or discontinue the Loyalty Programme, or alter the earning and redemption rates, at any time with appropriate notice to users.
g. The Milestone-Based Benefits programme (Bronze, Silver, Gold, Platinum tiers) is a future feature. Details will be communicated when activated.
a. Easy Cater connects you with professional catering service providers and event venues (including lawns and banquets) for events such as weddings, birthdays, corporate events, and other gatherings.
b. Plate-based pricing applies for catering services - the per-plate cost is set by the respective caterer and communicated clearly at the time of booking.
c. Event venue rental charges are set by the respective venue and displayed transparently during booking.
d. Advance payment of 100% of the booking amount is required at the time of booking.

Specific cancellation policies of the individual vendor (caterer or venue) shall prevail where they are more favourable to you. Easy Cater may negotiate exceptions in legitimate circumstances.
a. Easy Cater connects users planning events with qualified event helpers ("Helpers") for setup, serving, coordination, and cleanup at events.
b. Helpers are charged at Rs. 300 per Helper per hour. Full payment is required at the time of booking.

a. Businesses may register corporate accounts on the Easy Cater Platform by selecting 'I'm signing up for a company' at the time of registration and providing the required company details, including legal name, PAN, and GSTIN.
b. Corporate accounts support role-based access - Administrator, Manager, and Employee - with differentiated permissions and spending controls as specified in the Platform documentation.
c. The Corporate Wallet feature (prepaid company funds for employee orders) and advanced reporting dashboards are future features. Details will be communicated upon activation.
You acknowledge and agree that the Services are provided "as is" and "as available" and that your use of the Services shall be at your sole risk. To the fullest extent permitted by applicable law, EasyCater Services Platform Private Limited, its affiliates, officers, directors, employees, agents, branches, subsidiaries, and licensors ("Easy Cater Parties") disclaim all warranties, express or implied, in connection with the Services and your use thereof. The Easy Cater Parties make no warranties or representations regarding the accuracy, completeness, or quality of the content available through the Services, and assume no responsibility for any errors, inaccuracies, personal injury or property damage, unauthorized access to personal information, interruption of Services, bugs or viruses, loss of data, or any other issues arising from your use of the Services.
To the fullest extent permitted by applicable law, in no event shall the Easy Cater Parties be liable to you for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages whatsoever, however caused and under any theory of liability, including but not limited to loss of profit, loss of goodwill or business reputation, loss of data, or other intangible loss arising from or in connection with your use of the Services.
You agree to indemnify, defend, and hold harmless the Easy Cater Parties from and against any third-party claims, damages, actions, proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) arising as a result of, or in connection with: (i) Your Content; (ii) your unauthorized use of the Services; (iii) your access to and use of the Services; (iv) your violation of the rights of any third party; or (v) your breach of these Terms, including any infringement of intellectual property rights. Easy Cater retains the exclusive right to settle, compromise, and pay any claims brought against it without your prior consent.
The section headings in these Terms are for reference only and shall not be used to interpret any provisions of these Terms.
These Terms, together with Easy Cater's Privacy Policy and Content Guidelines, constitute the entire agreement between you and Easy Cater concerning the Services. No failure or delay by Easy Cater in exercising any right or privilege under these Terms shall constitute a waiver of such right.
If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a competent court, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and Easy Cater. You shall have no authority to bind Easy Cater in any form or manner.
These Terms shall be governed by the laws of India. The Courts at Vadodara, Gujarat shall have exclusive jurisdiction over any dispute arising under or in connection with these Terms. You must commence any legal action against Easy Cater within one (1) year after the alleged harm initially occurs. Failure to do so shall forever bar any claims or causes of action regarding the same facts or occurrence.
Easy Cater complies with the Digital Personal Data Protection Act, 2023. All personal data collected is encrypted using industry-standard protocols. Users may request deletion of their personal data by writing to support@easycater.co.in. Easy Cater will process such requests within 30 days, subject to legal retention obligations. Some data may be retained for tax compliance and operational purposes in accordance with applicable law.
You may not frame the Easy Cater Platform or link the Services to any website containing inappropriate, defamatory, infringing, obscene, or unlawful content. Any violation may, at Easy Cater's sole discretion, result in termination of your access to the Services.
Easy Cater respects intellectual property rights and requires those using the Services to do the same. Easy Cater may, in appropriate circumstances, remove or disable access to material on the Services that infringes copyright. The Easy Cater Platform operates in compliance with the following applicable Indian laws and regulations:
Easy Cater provides a structured grievance redressal mechanism for all users:
Level 1 - In-App Resolution: Direct communication with the merchant or delivery pilot through the Easy Cater application, and automated support responses.
Level 2 - Customer Support: Email or phone support at support@easycater.co.in. Easy Cater aims to respond within 24-48 hours and resolve grievances within 48 hours.
Level 3 - Escalation: Senior team review and management decision-making. Resolution communicated within 5-7 business days of escalation.
Level 4 - Legal Escalation: If the dispute cannot be resolved through internal mechanisms, the parties may pursue arbitration or legal proceedings as per the laws of India. Courts at Vadodara, Gujarat shall have exclusive jurisdiction.
